Bonjour,
Il y a quelques jours, un poste intéressant a été mis en ligne dans le groupe FB d'expats de Leiden. Comme nous avons souvent ce genre de questions ici, j'ai pensé que ça pouvais en intéresser plus d'un sur les droits de locataires en matière de caution, on ne compte plus les propriétaires qui essayent de ne pas rendre cette fameuse caution ou 'd'en rendre le moins possible... Trop de locataires laissent tomber l'affaire alors que tres souvent, ils sont dans leur droit.

PS: j'ai évidemment demandé l'accord de l'intéressé avant ce post, son message sera également publie sur le site de DutchReview apparemment.

After having won a legal case against our old landlord (full deposit back + costs for the legal case YAY), here are some fun facts from the lessons I've learned:

1. If you want to move out and terminate your contract, always send the letter "aangetekend" no matter how good the relationship with the landlord is

2. If your landlord does the checkout without you, claiming it was impossible to do it together with you (and this isn't true) this alone is reason enough to get back your deposit in full.

3. If the landlord forgets to do the checkout before you move out and doesn't give you the chance to fix things yourself, again: you get your deposit back since you need to have this chance by law.

4. If the landlord (or an agency) makes fotos of your flat with the goal to show that he needed the full deposit he also needs to present fotos from before you moved in, since HE claims that it's not in that state anymore and therefore HE needs to prove it. Better yet: if you move in, make your own fotos of everything that is not 100% so you can prove it was like that before.

5. Don't try to argue with the landlord or agency on your own if it is getting weird, go to the juridisch loket, talk to the advocate they send you to, whole different story )

6. Be patient: it took 18 months in our case
